The "Patient Protection and Affordable Care Act" (PPACA) (P.L. 111-148) and the "Health Care and Education Reconciliation Act of 2010" (H.R. 4872) were signed into law March of 2010. A major part of this law is the Employer Shared Responsibility provision that went into effect January 1, 2015. Are you prepared? Are you aware of the functionality PeopleSoft has already delivered? We are continuously delivering enhancements around the Affordable Care Act. In fact we have just recently delivered some additional enhancements to our Base Benefits module. Office of Federal Contract Compliance Programs (OFCCP) announces Final Rule: Section 503 Rehabilitation Act and Vietnam Era Veteran’s Readjustment Assistance Act (VEVRAA)
On August 27, 2013, the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) announced a Final Rule that makes changes to the regulations implementing:
• Section 503 of the Rehabilitation Act of 1973, as amended (Section 503) at 41 CFR Part 60-741. Section 503 prohibits federal contractors and subcontractors from discriminating in employment against individuals with disabilities (IWDs), and requires these employers to take affirmative action to recruit, hire, promote, and retain these individuals.
• The Vietnam Era Veterans’ Readjustment Assistance Act, as amended (VEVRAA) at 41 CFR Part 60-300. VEVRAA prohibits federal contractors and subcontractors from discriminating in employment against protected veterans, and requires these employers to take affirmative action to recruit, hire, promote, and retain these veterans.
The Final Rule was published in the Federal Register on September 24, 2013, and becomes effective on March 24, 2014. The goal of these rules is to further clarify the requirements to effectively recruit, hire, promote and retain individuals with disabilities and Veterans.
We are currently in the process of analysis of this new legislation and its impacts to the business processes supported by PeopleSoft HCM. We are tracking the requirements and issues in the following BUG IDs:
• BUG 17456466 - WILL ORACLE BE ADDRESSING THE CHANGES RULED IN THE DOL VEVRAA SECTION 503 CH2. – This addresses the reporting for Disabled Employees
• BUG 17456416 - WILL ORACLE BE ADDRESSING THE CHANGES RULED IN THE DOL VEVRAA SECTION 503, 60-74 – This addresses the reporting for Disabled Applicants
• Bug 17510724 - OFCCP - VEVRAA & SECTION 503 - CHANGES REQUIRED FOR MARCH 24, 2014 - Veterans Information – This addresses the reporting for Veterans
While we understand the requirement to implement these changes by March 2014, as with any new legislation we need to understand fully what the requirements are and the impacts across all products in HCM to deliver a complete solution for our customers. A Position Statement outlining our strategy on this new legislation will be forthcoming and look to the BUG IDs for updates to the planned solution.

The HMRC announced changes to some of the requirements for submissions from April 2013 and published new versions of certain MIGs. These updates have been integrated into the PeopleSoft application as part of RTI 13-14 MIG Specifications for various file generation like EAS, FPS, EPS and NVREQ. All PeopleSoft Global Payroll United Kingdom customers will be required to comply with the legislative changes and complete migration to Real Time Information by October 2013 as stipulated by the HMRC. PeopleSoft Global Payroll United Kingdom provides these legislative changes to allow customers to start the migration process and for those customers chosen, take part in the pilot phase of the HMRC project.
Real Time Information will replace the EOY (End of Year) and In-Year Filing processes that currently exist and all employers in the United Kingdom will be legally bound / compliant by the date specified, October 2013.
PeopleSoft Global Payroll for United Kingdom products have been adding functionality along the way to support the requirements for Real Time Information known as RTI. A whitepaper outlining the changes that have been introduced by HMRC for the tax year 2013-14 (including the earlier Year Updates for 2012–13) is now available on My Oracle Support, Document ID 1586706.1. This document provides valuable information for UK based employers (including UK subsidiaries of overseas organizations) who plan to implement RTI in PeopleSoft Global Payroll United Kingdom to comply with HMRC regulations. We advise customers to review & keep up to date.

The Federal Defense of Marriage Act (“DOMA”) was enacted September 21, 1996. US law did not recognize same-sex marriage granted under the laws of other states. This act defined "marriage" as a heterosexual union and had defined "spouse" as “a person of the opposite sex who is a husband or a wife." While the act was in place the Internal Revenue Code adopted the definition of "spouse" from DOMA and excluded same-sex spouses from some of the taxation benefits a heterosexual spouse. On June 26, 2013 the U.S. Supreme Court declared Section 3 of DOMA, which denied federal recognition of same-sex marriages, unconstitutional. However, this left in place Section 2, which allowed states to refuse to recognize same-sex marriages performed in other states.
On August 29, 2013 IRS issued ruling IR-2013-72 which stated same-sex couples, legally married in a jurisdiction that recognizes their marriage will be treated as married for federal purposes. The ruling applies regardless of whether the couple lives in a jurisdiction that recognizes same-sex marriage or a jurisdiction that does not recognize same-sex marriage. The PeopleSoft team is working hard to define the areas of impact to the Benefits, PeopleSoft Payroll for North America, and Payroll Interface Products. We will be delivering some changes as early as Tax Update 13-E as we continue to analyze the complete scope and impact to the PeopleSoft product lines. The Australian Government, aiming at efficiencies in reporting data across organizations within Australia, has carried out a comprehensive review that examined the current structure and operations of the superannuation industry as their pilot project. An attempt to streamline the way data is reported by multiple parties within the industry has lead to the rise of Data and Payment Standards (The Standard) that received royal assent on 28th June 2012. The industry will regulate The Standard to bring in efficient data exchange between Super Funds, RSA providers, Employers, Financial Institutions and the ATO. On Wednesday, June 26, 2013, the U.S. Supreme Court declared Section 3 of the Defense of Marriage Act (DOMA) to be unconstitutional. This court ruling overturned a provision of the law that had denied federal benefits granted to persons in opposite-sex marriages to persons in same-sex marriages who were legally married in states that recognize same-sex marriage. This court ruling will allow same-sex couples who are legally married in states that recognize same-sex marriage to receive the same federal benefits granted to opposite-sex couples. PeopleSoft anticipates system changes will be needed once guidance is published on this topic by the Internal Revenue Service, the Social Security Administration, and other U.S. government agencies. Please be assured that our legislative analysts are monitoring this situation daily.
